1. INTRODUCTION

1.1. PURPOSE OF POLICY

Mobi Repairs Group SA (“us”, “we,” “Company”) is committed to respecting the privacy rights of visitors and other users of mobiFix Services at https://www.mobifixsa.com/ (the “Site”) as well as in-store at our walk-in repair centre’s and our on-line eCommerce store. We created this Privacy Policy (this “Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair and legal information practices. This Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site, each of which may have data collection and use practices and policies that differ materially from this Policy.

By using this website, you consent to the data practices described in this policy statement which is also addressed via our online or walk-in book ins.

1.2. PROTECTION OF PERSONAL INFORMATION ACT, 2013 (POPI)

You acknowledge that by using this website you may be providing us with personal data, which may be protected by data protection legislation, including inter alia, the Protection of Personal Information Act, 2013(POPI). You authorize us to process to process all such personal data and to transmit any such personal data to any affiliate (which affiliate may also process such data) for the purposes of completing a repair job or sale whether online or in-store, including the marketing of our services and credit controls.

1.3. NOTICE CONCERNING CHILDREN

PLEASE NOTE: We are a general audience site, and do not direct any of our content specifically at children under 13 years of age pursuant to the Children’s Online Privacy Protection Act of 1998.

2. INFORMATION COLLECTION PRACTICES

2.1. WHAT BASIC INFORMATION DOES THE COMPANY COLLECT?

In operating the Site and our walk-in repair centre’s, we collect personal information from you in a couple of different situations. The first is if you should contact us via the “repair device” page. In doing so, you will provide us with your name, number and email address. The second is if you leave a comment to a blog post or newsletter during which you may be asked for a name and other information. You are not required to provide us with information via these two methods to use and enjoy the Site.

2.2. WHAT ADDITIONAL INFORMATION DOES COMPANY COLLECT?


a) AUTOMATIC COLLECTION. Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.
b) COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Site. Cookies help us learn which areas of our Site are useful and which areas need improvement through programs including, but not limited to, Google Analytics. We may also use cookies from third party social sites and programs including, but not limited to, Facebook, Google Plus and Twitter. You can choose to disable cookies through your browser or independent programs available online. However, if you choose to disable this function, your experience at our Site may be diminished as some features may not work as they were intended.
c) SPONSORS AND ADVERTISERS. We may decide to accept sponsorship and advertisements on the Site. Should this occur, you should assume said sponsors and advertisers will be given access to the impressions and click data on their marketing pieces. Your personally identifiable information will never be revealed to them by us.

d) In order for us to successfully process and expedite a repair or sale when your book in online or at a mobiFix walk-in repair centre, we will also require to capture in our CRM/POS software System- your name, Email address, Phone numbers, content of request, business name and Vat number where applicable, and Pass-codes of the devices requiring repairs, in order to be able to access the device for assessment, quoting and repairs. This will be explained upon in-store booking as well.

e) Additional information that may be required are your bank details for payments made by you or remitted to you by us, your signature on our relevant Disclaimer forms.

f) Computer and smart device hardware and software information required for repair or upgrades upon book-in, which is required for assessments.

 

3. USE AND SHARING OF INFORMATION

3.1. WHAT DOES COMPANY DO WITH COLLECTED INFORMATION?

a) PERSONAL INFORMATION. We do not disclose the personally identifiable information to any third parties other than those that we use to facilitate the functioning of the site such as a hosting company and email program for mailings.

b) ANONYMOUS INFORMATION. We use anonymous information to analyze our Site traffic. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

c) USE OF COOKIES. Promotions or advertisements displayed on our site may contain cookies. We do not have access to or control over information collected by outside advertisers on our site.

d) DISCLOSURE OF PERSONAL INFORMATION. We may disclose any information we have for you if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on us, (2) protect and defend our rights or property or the users of the Site, or (3) act under exigent circumstances to protect the safety of the public or users of the Site.

e) SALE OF INFORMATION. In order to accommodate changes in our business, we may sell or buy portions of the Site or our company, including the information collected through this Site. If Company or substantially all of its assets are acquired by a third party, user information will be one of the assets transferred to the acquirer.

3.2. HOW DO WE USE THE INFORMATION COLLECTED?

We process personal information primarily for the purpose of providing a device repair or sales service to you and in addition to:

  • Maintain and improve our website and offering
  • Keep you informed in respect of your repair or purchase
  • Communicate with you directly or through one of our partners, including customer services
  • Provide you with updates and for marketing and promotional purposes, if you have given your permission for us to do so
  • Send you Emails and text messages
  • Detect and prevent Fraud
  • Effectively process your transaction
  • Comply with legal, auditing and regulatory record keeping requirements
  • Verify your Identity
  • Share information with relevant service providers with which we have a confidentiality agreement in place to render a service required

3.3 WHO PROCESSES YOUR PERSONAL INFORMATION

MobiFix employees, who may also arrange for third party service providers such as accountants, IT Service providers, and any statutory regulatory body, all of whom are contracted by us to client confidentiality covering the storage and disclosure of your personal information in order to safeguard it, prevent unauthorized access and to comply with relevant data protection laws.

3.4 YOUR RIGHTS TO ACCESS AND CORRECT INFORMATION

If you have provided consent, you may withdraw consent. You may also request, subject to confidentiality, to:

  • Access your Personal Data as processed by us
  • Ask for correction or erasure of your personal Data
  • Request portability where applicable, of your Personal Data i.e. that you have provided us, are returned to you or transferred to the person of your choice, in a structured, commonly used and machine-readable format.

4. SECURITY & STORING OF PERSONAL INFO


mobiFix repair Centre’s and The Site has security measures in place to prevent the loss, misuse, disclosure, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss to you or to any third party arising out of any such loss, misuse, or alteration. This includes the use of encryption such as Secure Socket Layer (SSL) protocol, when a credit card number is transmitted to other websites.

mobiFix does not sell, rent or lease its customer lists to third parties, but may share with our service providers in order to expedite the required service, who are prohibited from using your personal information except to provide these services.

mobiFix does not use or disclose sensitive personal information, such as race, religion, gender or political affiliations.

The length of the storage period is determined by relevant local data protection law and regulations and we will delete your personal information once it is no longer required for processing purposes.

Any such change, update, or modification will be effective 30 days after posting on the Site. It is your responsibility to review this Policy from time to time to ensure that you continue to agree with all of its terms.
